Volume 20: Issue 3: December 2010

Sample Story : Between the devil and the deep blue sea: Fear, flight and the politics of asylum by Jessie Taylor

This edition of the Human Rights Defender looks at the challenges surrounding the recognition of refugee rights within the Asia pacific region – in particular, focusing on Australia, Papua New Guinea and areas of South East Asia. Within all these regions, there exists a clear need for increased accountability, transparency and compassionate regional cooperation between governments.

Sample Story : The human right to sanitation - essential for survival, health and a life of dignity by Catarina de Albuquerque

This edition of the Human Rights Defender focuses on sanitation. Sanitation is in many ways a taboo subject, in part, because it is related to very intimate
and private bodily functions. Inadequate sanitation is also a subject that is expensive
for governments to address, particularly if ‘big pipe’ infrastructure solutions are
sought, rather than smaller, decentralised solutions. Accordingly, sanitation is what might be described as a ‘sleeper’ issue: it is very important but few governments or organisations make it a top priority for attention.

Sample Story : Interpreting the Capability Approach: Thin and Thick Views? by Mozaffar Qizillbash.

This edition of the Human Rights Defender focuses on human rights and the capabilities approach. This edition of the Human Rights Defender looks at the relationship between human capabilities, development and human rights. The capability approach focuses on what human beings can actually do and want to be. It is centred on human
well-being and the circumstances that people live in – rather than merely on what rights people should have.

Sample Story : Perspectives on social rights justiciability in Argentin, Carolina Fairstein, Paola Rey Garcia and Gabriela Kletsel

This edition of the Human Rights Defender focuses on the practice of implementing economic, social and cultural rights. The authors of the articles are almost all practitioners in Australia in legal aid or community legal centres or work in human rights internationally.
What is striking about each of the articles, is the innovative and creative ways in which law is being used to make economic and social rights real and justiciable for disadvantaged communities.

Sample Story : Climate Change and Indigenous Peoples' Human Rights , Emma Partridge

The theme of this edition of the Human Rights Defender is climate change and human rights. This edition discusses these issues both in the context of climate change as a regional issue and its impact on particular human rights. Articles adopting a regional focus consider climate change impacts in the United States, Australia, Nepal, the Arctic and the Pacific.  The potential of climate change to adversely impact a number of human rights is generally acknowledged and this issue focuses on the right to life, food, water, health and housing and the rights of indigenous peoples. Developments in climate change litigation are also canvassed.  The last article in this edition is a stand alone piece on child protection and deportation in the context of Australian immigration.
